Distance Sales Agreement

Review the professional terms and conditions governing all digital infrastructure purchases made through GlobeTier. Our agreements are designed to ensure transparency, security, and full compliance with consumer protection regulations across our operating jurisdictions in Chile, the United States, the United Kingdom, and Egypt.

1. Parties and Execution

This Distance Sales Agreement (“Agreement”) is electronically executed between the parties defined below in accordance with international e-commerce regulations and consumer protection standards.

THE SELLER: GlobeTier Infrastructure Solutions (hereinafter "GlobeTier"), a global entity registered and operating in Chile, the United States, the United Kingdom, and Egypt. GlobeTier provides managed hosting, cloud infrastructure, and digital services via globetier.com and its authorized portals.

THE BUYER (CUSTOMER): The individual or legal entity defined by the identification, address, and contact information provided during the registration or checkout process on GlobeTier’s website (hereinafter "Customer").

By confirming the "I have read and accepted the Distance Sales Agreement" checkbox during checkout, the Customer acknowledges full understanding and legal acceptance of all terms herein.

2. Subject and Scope

The subject of this Agreement is the determination of the mutual rights and obligations of the parties regarding the remote sale of Digital Services (including but not limited to Shared Hosting, VPS, Dedicated Servers, Domain Registration, and SSL Certificates) ordered by the Customer through GlobeTier's electronic platforms.

All transactions under this Agreement are subject to GlobeTier’s general Terms of Service (ToS). The Agreement is considered finalized once the order is confirmed and the payment is successfully processed by GlobeTier.

3. Service Delivery and Execution

GlobeTier specializes in "Instant Provisioning" services. Delivery is executed as follows:

  • Activation: Upon payment confirmation, service credentials (Control Panel, SSH, FTP, or Login access) are dispatched to the Customer’s registered email address.
  • Completion: Service delivery is considered legally complete the moment the access information is sent to the Customer.
  • Responsibility: The Customer assumes full responsibility for the security and confidentiality of the provided access credentials.

4. Right of Withdrawal and Exceptions

In accordance with international digital commerce standards, the right of withdrawal (cancellation) is subject to the nature of the service:

Instant Digital Performance: Services that are performed instantly in electronic form or delivered immediately to the consumer (such as Domain Registrations, SSL Certificates, and activated Hosting/Server instances) are exempt from the standard 14-day withdrawal period once execution has begun with the Customer's consent.

Customer Consent: By completing the purchase, the Customer explicitly requests that the service begins immediately and acknowledges that the right of withdrawal cannot be exercised for services already provisioned and activated. Refund eligibility for such cases is governed strictly by our Refund Policy.

5. Pricing and Global Billing

Service fees are specified at the time of the order. As a global provider, GlobeTier supports billing in multiple currencies (USD, GBP, CLP, EGP) based on the regional entity handling the transaction.

  • Taxes: All applicable taxes (VAT/GST/Sales Tax) are calculated and displayed during the checkout process based on the Customer's tax jurisdiction.
  • Renewals: GlobeTier reserves the right to update service rates for future renewal periods. Continued use of the service after a price update constitutes acceptance of the new rates.

6. Jurisdiction and Dispute Resolution

Given the multi-national registration of GlobeTier, this Agreement shall be governed by the laws of the jurisdiction where the primary corporate entity handling the billing is registered (USA, UK, Chile, or Egypt).

In the event of a dispute, the Customer is encouraged to contact GlobeTier’s legal department at legal@globetier.com. If a resolution cannot be reached through mediation, the parties agree to the exclusive jurisdiction of the courts located in the billing entity's country of registration.
